Letter of intent

Contract

This contract is made on____________________________________ between________________________________________ (Party A)
located at_____________________________________________________ and ______________________________________________
, Foreign Language Teacher (FLT) for appointment of Party B to be a Teacher in and by Party A.

It is mutually agreed as follows:

1. Party B will be hired by Party A from____________________________ hrough_____________________________and after this period of time if both sides agree to an extension.

2. The liabilities of both sides shall be as follows respectively:

2.1 Party A's Obligations:

2.1.1 Party A shall introduce to Party B the laws, decrees enacted by the Chinese government, the Party A's work system and regulations concerning administration of foreign experts.

2.1.2 Party A shall conduct direction, supervision and evaluation of party B's work.

2.1.3 Part A will reimburse a round-trip economy class flight ticket from__________________ to the airport nearest to the teacher's permanent residence in his/her country, or will pay equivalent in cash, if Party B's contract period is one academic year (two semesters). Part A will reimburse a one-way economy class flight ticket from_____________________ to the airport nearest to the teacher's permanent residence in his/her country or will pay equivalent in cash, if Party B's contract period is a half year (one semester).

2.1.4 A salary of____________________ per month shall be paid to the FLT who will work a maximum o______________________f a week.

2.1.5 Party A shall provide Party B co-workers and two to four free Chinese language lessons each week.

2.1.6 Party A shall provide Party B a free housing, which is located on the campus, a single private room, air-conditioned, furnished and with a kitchen provided as well. The FLT can eat in the cafeteria on the campus for free, or cook in his/her own kitchen.

2.1.7 FLT will be provided with 200 RMB a month to cover his/her electricity usage.

2.1.8 Provide, upon the completion of this agreement, the FLT a subsidy towards the medical expenses in the amount of 100 RMB per month and a total subsidy of 100 $US towards the medical insurance purchased by the FLT.

2.1.9 Part A will cover expenditure of medical exam to start a job, the cost of work visa, Foreign Expert Certificate, work permit, and residence permit. Part B will pay his/her own tax.

2.1.10 Party B will be paid 2200Yuan travel bonus by Party A at the end of the second semester for one year contract. Party B will be paid 1100Yuan travel bonus by Party A at the end of the first semester for a half year contract.

2.1.11 Part B shall his/her pay local and overseas telephone expenses. Part B shall supply the 24 hours broadband Internet connection at Part's B apartment for free.

2.1.12 During the term of this Contract meals served in the cafeteria to Part B will be free.

2.2 Party B's Obligations:

2.2.1 Party B shall observe the laws, decrees and relevant regulations enacted by the Chinese government and shall not interfere in China's internal affairs.

2.2.2 Party B shall observe Party A's work system and regulations concerning administration of foreign experts and shall accept Party A's arrangement, direction, supervision and evaluation in regard to his or her work. Without Party A's consent, Party B shall not render service elsewhere or hold concurrently and post unrelated to the work agreed on with Party A.

2.2.3 The FLT shall be responsible for the punctual attendance at the classes, meetings and celebration activities and complete the tasks agreed on schedule and the contract.

2.2.4 During the period of the Agreement, the FLT shall fulfill their duties, maintaining the highest standards. Apart from the teaching of English, they shall actively and timely participate in any supplementary activities relating to the improvement of spoken English, the reputation of the university such as English Corner and delivery of some lectures about the backgrounds of Party B's own country (one or two lectures each semester).

2.2.5 Party B shall respect China's religious policy, and shall not conduct religious activities with the status of an expert.

2.2.6 Party B shall respect the Chinese people's moral standards and customs.

2.3 Revision, Cancellation and Termination of the Contract

2.3.1 Both parties shall abide by the contract and should refrain from revising, canceling, or terminating the contract without mutual consent.

2.3.2 The contract can be revised, canceled, or terminated with mutual consent. Before both parties have reached an agreement, the contract should be strictly observed.

2.3.3 Party A has the right to cancel the contract with a written notice to Party B, under the following conditions:

a) Party B does not fulfill the contract or does not fulfill the contract obligations according to the terms stipulated, and has failed to amend after Party A has pointed it out.

b) According to the doctor's diagnosis, Party B cannot resume normal work.

2.3.4 Party B has the right to cancel the contract with a written notice to Party B a month in advance, under the following conditions:

a) Party A has not provided Party B necessary working and living conditions as stipulated in the contract.

b) Party A has not paid Party B as scheduled.

2.4 Breach Penalty

2.4.1 When either of the two parties fails to fulfill the contract or fails to fulfill the contract obligations according to the terms stipulated, that is, breaks the contract, it must pay a breach penalty of US $500 or the equivalent in _______________RMB.

2.4.2 If Party B asks to cancel the contract due to events beyond control, it should produce certifications by the department concerned, obtain Party A's consent, and pay its own flight expenses; if Party B cancels the contract without valid reason, it should pay its own return expenses and pay a breach penalty to Party A.

2.4.3 If Party A asks to cancel the contract due to events beyond control, with the consent of party B, it should pay Party B's return expenses; if Party A cancels the contract without valid reason, it should pay Party B's return expenses and pay a breach penalty to Party B.

2.5 If both sides agree and deem it necessary, this agreement can be amended.

2.6 This Agreement shall be subject to the law of P. R. China and serves as attachments of the contract issued by the State Administration of Foreign Experts Affairs. Any disputes that arise can't be resolved between both parties shall be submitted to arbitration with the jurisdiction of the local court in P. R. China.
